چكيده: مباحث گسترده ای در باب چگونگی استخراج قانون شرعی از قرآن و سنت در بین متکلمین و فقها در طول تاریخ اسلام مطرح شده است. این امر منشا گفتگو، تبادل نظر و حتی اختلافات جدی در بین نه تنها شیعه و سنی بلکه در میان خود مکاتب سنی بوده است. در این جلسه، در باب چیستی قانون اسلامی به طور کلی از نظرگاه تبعیت و مسئولیت پذیری فردی و اخلاقی به هم اندیشی می نشینیم. به نظر می رسد همه مومنین اعم از شیعه و سنی با معضل و تجربه‌ی مشابهی در برابر وحی و امر قدسی مواجهند و نهایتاً به تکلیف رسیدن و به بلوغ اخلاقی رسیدن در اسلام به معنای درک این موقعیت معضل‌گونه‌ای است که همه ما در موقعیت انسانی با آن مواجهیم. در قرآن از این موقعیت معضل‌گونه با تعبیرات متعددی یاد شده است که یکی از آنها «فی کبد» است

 

Abstract:
The Philosophical discussions around the foundation of laws (Shari’a) in Islam have been a source of tension and discussion between not only Shiite and Sunni scholars but also between the Sunnis themselves leading to such divides as the schools of Mu’tazilite and Ash’arite. Each would consider either reason or revelation as the main source of legitimacy of the laws. In this talk, drawing on Ghazaali’s skeptic transcendental methodology, I would like to suspend dogmatic theological and sectarian presumptions and examine the experience of “following” the laws and its relation to the ethics of responsibility in a new philosophical light. We will discuss how Islam and the Qur’an depict the problematic situation of followers and invite Muslims to heedfulness and responsibility for each other.

About The Speaker:
Dr. Dehghani obtained a first Ph.D. in Linguistics from Allameh Tabataba’i University in Tehran, Iran, with a dissertation titled “Interpretation and Literary Theory: From Structuralism to Ricoeurian Hermeneutics” (2011). In 2019, he earned a second Ph.D. in Philosophy from Boston College, where he was a Fellow at the Clough Center for Constitutional Democracy (2014-2018). His dissertation, “The Topology of Community in Aristotle: a Phenomenological Approach,” offers a phenomenological reading of Aristotle’s formulation of a “just community” and its appropriation in Islamic thought.
Dr. Hessam Dehghani is a Lecturer in Philosophy at Bentley University, and a Lecturer in Persian and Arabic language and linguistics at Boston College.

Mr. Mostafa Daneshgar is currently a PhD candidate in Electrical and Computer Engineering at Wayne State University in Michigan. Prior to coming to US in 2010, he studied Shiite theology and Shiitjurisprudence at the Qum Seminary and continued these studies when he immigrated to Syria where he attended the Seminary of Zenobia at Damascus. Mr. Daneshgar has written more than 200 articles and speeches about Islam, Shiite, and relations between religions, specifically Shiite, as well as cultural and social challenges in Persian, Arabic, and English.

Mr. Mostafa Daneshgar is currently a PhD candidate in Electrical and Computer Engineering at Wayne State University in Michigan. About the Speaker:

Dr Bateni is a Staff Research Scientist at Google Research working on Design of Algorithms for Analysis of Big Data. He obtained MS and Ph.D. degrees in
Computer Science from Princeton University. Apart from these, he is interested  in Quranic and religious discussions.
